This End‑User License Agreement (“Agreement”) is a legal agreement between you (“User”) and VitalSpark by Ferdie (“Company,” “we,” “us,” or “our”). By downloading, installing, or using the VitalSpark mobile application (“App”), you agree to be bound by this Agreement.
If you do not agree, please do not use the App.
1. License to Use the App
We grant you a limited, non‑exclusive, non‑transferable, revocable license to use the App for your personal, non‑commercial use.
You do not own the App — you are only receiving permission to use it.
2. Prohibited Actions
You agree not to:
- Copy, modify, or distribute the App
- Reverse‑engineer, decompile, or attempt to access the source code
- Sell, rent, or sublicense the App
- Use the App for unlawful or harmful purposes
- Interfere with the App’s functionality or security
3. Health & Fitness Disclaimer
VitalSpark provides general fitness, wellness, and nutrition guidance. It is not medical advice.
You should consult a qualified healthcare professional before starting any fitness or nutrition program, especially if you have injuries, medical conditions, or concerns.
You use the App at your own risk.
4. Updates & Changes
We may update, modify, or discontinue parts of the App at any time. These updates may:
- Add new features
- Improve performance
- Fix issues
Your continued use of the App means you accept these changes.
5. Subscription & Payments
If you purchase a paid plan (Pro or Elite):
- Payments are handled through the App Store or Google Play
- All billing, renewals, and cancellations follow their policies
- We do not process or store your payment information
Refunds are subject to the Refund & Billing Policy on our website.
6. Termination
We may suspend or terminate your access to the App if:
- You violate this Agreement
- You misuse the App
- You engage in harmful or fraudulent behavior
You may stop using the App at any time by uninstalling it.
7. “As‑Is” Disclaimer
The App is provided “as is” and “as available.”
We do not guarantee:
- Specific results
- Error‑free performance
- That the App will always be available
To the fullest extent allowed by law, we are not responsible for any damages resulting from your use of the App.
8. Privacy
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.
9. Changes to This Agreement
We may update this Agreement from time to time. When we do, we will update the “Last Updated” date at the top.
Continued use of the App means you accept the updated terms.
